Charges Dropped: Florida Man Tells Police He Defecated During Domestic Battery Incident

Alachua County Sheriff's Office deputies arrested Alachua, Florida, man Kiva Swander-Kirby, 30, on Wednesday and charged him with domestic battery by strangulation.

The arrest report states, “[Swander-Kirby] stated he wanted an open conversation where he was free to discuss negative things. The victim asked when [Swander-Kirby] would return to her to continue the conversation. Swander-Kirby told her he was tired and wanted to go to sleep.”

This escalated to a screaming match where it was alleged that a naked Swander-Kirby defecated in the middle of the floor. The victim saw his mental instability and screamed for help.

Swander-Kirby reportedly put his hand over the victim’s mouth to stop her from screaming, at the same time plugging her nose.

Based on the report, it isn’t clear if Swander-Kirby was naked from the start of the incident or took his clothes off during the argument. 

Deputy Christopher Dasher reported that while investigating, Swander-Kirby “gave a very vague version of events but did admit to defecating on the floor.”

Swander-Kirby refused to answer questions after getting a Miranda warning.

Swander-Kirby's bond is set at $40,000.
